Administering an estate: the steps before distribution

The procedure
Identify the will, the estate’s assets and liabilities, and the person entitled to seek the appropriate court grant. Depending on the circumstances, this may involve probate or letters of administration. Under Cap. 189, the appointed personal representative must file an inventory within the time directed by the court, collect the estate and address lawful debts before distributing the remainder.
What deserves attention
Do not distribute funds simply because the beneficiaries agree. Expenses, debts, competing claims and the applicable succession rules must first be assessed. Estate money should be handled through the required estate bank account, subject to any court-authorised exception. Keep clear records of receipts, payments and decisions.
Prepare for your consultation
Gather the death certificate, original will if available, family details, property information, bank details and evidence of liabilities. Flag overseas assets and any disagreement early. An orderly inventory and a clear record of outstanding obligations help the representative plan administration without making premature promises to beneficiaries.
